CIA with BA: Right to property with live-in partner discussed

These words came from Senator Alan Peter Cayetano as he concluded his advice to Ricca, who consulted about her right to a property she had acquired together with her live-in partner.

“Medyo matagal na po kaming magka-live-in ng boyfriend ko. We’re both of legal age and pareho naman po kaming single when we started the relationship. I can say happy naman po ako with the relationship. Eventually, nakapagpundar po kami kahit papaano ng lupa and do’n po ngayon nakatayo ‘yung bahay namin,” Ricca shared in ‘CIA with BA’ segment ‘Yes or No’ on Easter Sunday episode, March 31.

“So ‘yung lupa, nakapangalan po sa kanya,” she revealed.

She asked Kuya Alan and sister Pia Cayetano: “Meron po ba ‘kong karapatan do’n sa lupa?”

“Yes, may karapatan ka,” Pia directly answered.

“Ang napaka-importante na fact sa situation mo ay may legal capacity to marry kayong dalawa. Walang hadlang. So nung nagsama kayo, walang hadlang… the law considers you na para namang mag-asawa and therefore, ‘yung sweldo niyo while you’re living together, will be shared equally,” the senator noted.

“And then kung may property kayo. like [‘yung] sinabi mo naipundar, you are governed by co-ownership. Sa madaling salita, hati din kayo doon,” she explained.

For his part, Kuya Alan warned the viewers who might be in the same situation with Ricca.

“It’s always safe na maganda [ang] accounting niyo at nasa pangalan niyong dalawa. Bakit? E pa’no kung niloko ka?” he said.

“Halimbawa, meron si Maria at si Pedro. Sinabi ni Pedro, ‘Single ako. O, hati tayo, nabili mo ‘yung lupa.’ Later on lumabas, may asawa pala si Pedro at hinahabol ngayon [nung asawa],” Alan continued.

“So sa batas, kung actual na nag-contribute ka, mababalik sa ‘yo ‘yon. Pagka hindi actual na pera, halimbawa ‘yung housework mo, hindi maka-count ‘yon, wala kang parte do’n,” he explained.

“E pa’no kung sabihin nung asawa, ‘Hindi, zero kinontribute niyan.’ Tapos wala kayong dokumento, nasa pangalan lang nung lalake, [may] problema ka,” he noted.

‘CIA with BA’ carries on the legacy of Senator Rene Cayetano, the late father of the sibling senators. The senior Cayetano was a renowned lawyer who gained fame through his radio and TV program 'Compañero y Compañera,' which aired from 1997 to 2001.
